usa residence by investment
The Unites States has two primary residence by investment programs, the EB - 5 and the E - 2, both allowing investors to legally attain a residence permit though the establishment of a running and operating business within the Unites States. The applicant for residency may include his immediate family (spouse and children below the age of 18).
EB - 5 US Investor Visa
The EB - 5 US Investor Visa is an immigration based program which establishes permanent residence status (US Green Card issuance) for all qualifying applicants, which means that all successful applicants must immigrate and physically be present in the United States. It is important to note that successful EB - 5 applicants become liable for double taxation on their global income, meaning they would need to report and pay tax on any income generated outside the US. Under the EB - 5, the permanent residence card (Green Card) is issued for ten years and may be further renewed after that period. After a minimum physical stay of five years, EB - 5 permanent residence holders are eligible to apply for citizenship. The minimum financial requirement needed to qualify for the EB - 5 is an investment of USD 800,000 in an approved and qualifying business.
E - 2 US Investor Visa
The E - 2 US Investor Visa is a non - immigrant based program which allows investors to gain temporary residence status in the US. Unlike the EB - 5, E - 2 applicants are not tax liable on their global income and do not have to meet any physical residency requirements to maintain their residence status. While E -2 visa holders have access to similar benefits as permanent residence holders, they do not meet the eligibility for future citizenship. The US government has opened the E - 2 visa program to just over 80 countries under the US E - 2 Treaty; which means that not all nationalities are eligible to apply. Depending on the country and its agreement with the US, the validity of the E -2 visa may be as short as three months, or as long as five years. The E - 2 visa may be renewed under the condition that the business is still operational. The minimum financial requirement needed to qualify for the E - 2 is an investment of USD 150,000 in an approved business.

Key Features of the EB-5 Program
Investment Requirement: To qualify for the EB-5 program, investors must invest a minimum of $1.8 million in a new commercial enterprise. Alternatively, a reduced investment of $900,000 is permissible if the investment is made in a targeted employment area (TEA), which includes rural areas or regions with high unemployment.
Job Creation: The investment must lead to the creation or preservation of at least 10 full-time jobs for U.S. workers within two years of the investor's admission to the United States as a conditional permanent resident.
Conditional Residency: Upon approval, investors and their immediate family members (spouse and unmarried children under 21) receive conditional Green Cards, allowing them to live and work in the United States for two years.
Permanent Residency: After meeting the program requirements, including job creation, investors can apply for the removal of conditions and obtain permanent Green Cards, paving the way for U.S. citizenship in the future.
